How does it work?
The mediator will usually have a preliminary meeting with the parties and/ or their lawyers to try to establish the issues and decide what procedure will be used for this particular mediation. However, broadly there will be a series of meetings with the mediator, in the same room as your opponent and/or in separate rooms, during which the mediator will try to assist in the negotiations towards a settlement.
At the end of the mediation, the mediator will record the agreement which the parties have reached in a formal document (or assist the lawyers to do so, if they are present). This will finalise matters. |
