Confidentiality
Everything said within the mediation process is confidential and without prejudice until a formal agreement has been signed by all parties. Nothing that is said in private discussions with the mediator can be repeated to the other side without your permission.
Costs
Each party to the mediation is responsible for their own fees and these are calculated per party on a sliding scale dependent on the value of the claim. The rates are available upon enquiry and an estimate of the likely total fees will be given following the preliminary meeting once the issues have been defined.
Who is present in the mediation?
It is certainly quite common to have lawyers present and also experts such as surveyors, accountants etc. This is one of the issues that would be discussed and agreed by all parties at the preliminary meeting. |
